NOTICE is hereby given that on April 14, 2021, co-applicants Jaramillo Lands-Parcel B, LLC, 17 Calle de Montanas, Santa Fe, NM 87507, Village of Los Lunas, P.O. Box 1209, Los Lunas, NM 87031, and Haynes Cattle Company, P.O. Box 67, Los Lunas, NM 87031, filed Application No. (RG-17065 Enlgd. Into RG-9561)-T with the STATE ENGINEER for Permit to Change Point of Diversion, Place and Purpose of Use of Groundwater within the Rio Grande Basin of the State of New Mexico, for a period of ten (10) years under Water Use Lease, NMSA 1978 72-6-1 through 72-6-7.

Valencia County is the County affected by the diversion and in which the water has been or will be put to beneficial use. This notice is ordered to be published in the Valencia County News Bulletin.

The co-applicants propose to temporarily discontinue the diversion of up to 137 acre-feet per annum (afa) of ground water from seven (7) wells under RG-17065 Enlgd. being well RG-17065 located at a point where X=338,305.4 and Y=3,852,183.4; well RG-17065-S located at a point where X=341,180.2 and Y=3,852,940.1; well RG-17065-S-2 located at a point where X=339,266.6 and Y=3,854,556.6; well RG-17065-S-3 located at a point where X=339,916.5 and Y=3,856,244.8; well RG-17065-S-4 located at a point where X=338,377.2 and Y=3,853,956.8; well RG-17065 POD 6 located at a point where X=338,599 and Y=3,854,659; and well RG-17065 POD 7 located at a point where X=339,261 and Y=3,854,521; all X&Y coordinates are in meters, UTM Zone 13 North, NAD83, all located on land owned by the Village of Los Lunas, for municipal purposes owned by various owners within the Village of Los Lunas municipal water system, Village of Los Lunas, Valencia County.

The co-applicants further propose to commence the farm delivery requirement of up to 137 AFA associated with the above described right, with a point of diversion from Well RG-9561 located at a point where X=341,239 meters, Y=3,847,368 meters, UTM Zone 13N, NAD83, on land owned by the Jaramillo Lands-Parcel B, LLC, for the irrigation of 45.5764 acres of land described as Part of Tract 2, Tract 3, Tract 4, and Tract 5, Plat Showing Land Division Parcel “B” Land of Arturo Jaramillo, MRGCD Map 85, on land owned by the Jaramillo Lands-Parcel B, LLC. The above-described move-to tracts are generally located southwest of Tavalopa Drive and the Tome Acequia., Los Lunas, Valencia County, New Mexico.

This Application is filed under the Water-Use Leasing Act, NMSA 1978, Sections 72-6-1 through 72-6-7.

Application is made for a permit that, if granted, would expire on December 31, 2030. Upon termination or expiration of the desired permit, the subject water right will automatically revert to the move-from place of use pursuant to the applicable provisions in that permit.

Any person, firm or corporation or other entity asserting standing to file objections or protests shall do so in writing (objection must be legible, signed, and include the writer’s complete name, phone number, email address, and mailing address). If the protest does not include the complete name, phone number, email address, and mailing address, it may be deemed invalid and not accepted for filing unless Protestant provides with the protest an affidavit stating that it does not have one of the above-listed elements/requirements (phone number, mailing address, email address, etc.). The objection to the approval of the application must be based on: (1) Detriment; if detriment, you must specifically identify your water rights; and/or (2) Public Welfare/Conservation of Water; if public welfare or conservation of water within the state of New Mexico, you shall be required to provide evidence showing how you will be substantially and specifically affected. The written protest must be filed, in triplicate, with the State Engineer, 5550 San Antonio Drive NE, Albuquerque, NM 87109, on or before July 30, 2021. Facsimiles (faxes) will be accepted as a valid protest if the hard copy is hand-delivered or mailed and postmarked within 24-hours of the facsimile. Mailing postmark will be used to validate the 24-hour period. Protests can be faxed to the Office of the State Engineer, (505) 383-4030. If no valid protest or objection is filed, the State Engineer will evaluate the application in accordance with the provisions of Chapter 72 NMSA 1978.
