Valencia and Socorro Counties are the Counties affected by the diversion and in which the water has been or will be put to beneficial use. This notice is ordered to be published in the Valencia County News-Bulletin (Valencia County) and in the El Defensor Chieftain (Socorro County).

The co-applicants propose to temporarily discontinue (for a period of time commencing immediately and ending on December 31, 2030), the diversion of 165 acre-feet per annum (afa) of groundwater from seven (7) wells Permitted under RG-17065 Enlgd., being wells RG-17065 located at a point described as X=338,305.4 and Y=3,852,183.4, RG-17065-S located at a point described as X=341,180.2 and Y=3,852,940.1, RG-17065-S-2 located at a point described as X=339,266.6 and Y=3,854,556.6, RG-17065-S-3 located at a point described as X=339,916.5 and Y=3,856,244.8, RG-17065-S-4 located at a point described as X=338,377.2 and Y=3,853,956.8, RG-17065 POD6 located at a point described as X=338,599 and Y=3,854,659 and RG-17065 POD7 located at a point described as X=339,261 and Y=3,854,521, meters, UTM Zone 13 North, NAD 83, all located on lands owned by the Village of Los Lunas, for municipal purposes within the service area (owned by numerous owners), within the Village of Los Lunas municipal water system, Los Lunas, Valencia County, New Mexico.

The co-applicants further propose to commence the temporary diversion of 165 afa of surface water from the San Antonio Ditch, with a point of diversion on the Rio Grande at the San Acacia Diversion Dam (SP-1690-4), on land owned by the MRGCD, located at a point where X=326,225 meters and Y=3,792,219 meters, UTM Zone 13 North (NAD 83), for the irrigation of 55 acres of land, owned by 3JP Farm & Ranch, LLC., a Limited Liability Company, described as the south part of Tract 94 (8.72 ac.) and Tract 75 (8.64ac.), both located on MRGCD Map No. 175, and Tract 3 (0.52 ac.), Pt. of Tract 5A (2.65ac.), Pt. of Tract 5B (3.12ac.), Tract 6 (2.41ac.), Tract 7 (3.91 ac.), Tract 19A (1.80ac.), Tract 19B (0.29 ac.), Tract 21 (0.96ac.), Tract 23A (6.20ac.), Tract 23B (6.20ac.), Tract 23C (2.62ac.) and Tract 24 (6.96ac.), all located on MRGCD Map No. 176, all tracts located within Socorro County, NM. The move-to lands are generally located north of San Antonito Rd., and between S. Meira Rd., and NM State Highway 1, Socorro County, NM.

The surface water rights appurtenant to the subject move-to lands were previously severed under Permit No. SD-07853 into RG-17065 et. al., approved by the State Engineer on October 22, 2008 and by Permit No. SD-01717 & RG-2952 into RG-17065 et. al. and companion Temporary Lease Permit No. (RG-17065 et. al., into SD-01717 & RG-2952)-T, that were approved by the State Engineer on January 28, 2004. This temporary lease expired on January 22, 2014.

This application is filed under the Water-Use Leasing Act, NMSA 1978, Sections 72-6-1 through 72-6-7.

Any person, firm or corporation or other entity asserting standing to file objections or protests shall do so in writing (objection must be legible, signed, and include the writer’s complete name, phone number, email address, and mailing address). If the protest does not include the complete name, phone number, email address, and mailing address, it may be deemed invalid and not accepted for filing unless the Protestant provides with the protest an affidavit stating that it does not have one of the above-listed elements/requirements (phone number, mailing address, email address, etc.). The objection to the approval of the application must be based on: (1) Detriment; if detriment, you must specifically identify your water rights; and/or (2) Public Welfare/Conservation of Water; if public welfare or conservation of water within the State of New Mexico, you shall be required to provide evidence showing how you will be substantially and specifically affected. The written protest must be filed, in triplicate, with the Office of the State Engineer, District 1 Office, located at 5550 San Antonio Drive NE, Albuquerque, NM 87109-4127, on or before July 26, 2021. Facsimiles (faxes) will be accepted as a valid protest if the hard copy is hand-delivered or mailed and postmarked within 24-hours of the facsimile. Mailing postmark will be used to validate the 24-hour period. Protests can be faxed to the Office of the State Engineer, (505) 383-4030. If no valid protest or objection is filed, the State Engineer will evaluate the application in accordance with the provisions of Chapter 72 NMSA 1978.
