NOTICE is hereby given that on May 3, and amended on May 24, 2021, co-applicants, Darleen Denise Baca, P. O. BOX 3211, Durango, CO 81302; Meadow Village Partners, LLC, a Colorado limited liability company, co Reed Slingerland; Craig Terrace Partners, LLC, a Colorado limited liability company, co Reed Slingerland; and Intermountain Mule Deer, LLC, a Colorado limited liability company, co Michael L. LeWarne, all located at 2480 E. Glen Canyon Rd., Green Valley, AZ 85614, filed Application No. (SD-07429-G into RG-97542) with the STATE ENGINEER for Permit to Change Place of Use, Purpose of Use and Point of Diversion from Surface Water to Groundwater in the Rio Grande Underground Water Basin of the State of New Mexico.

Socorro, Valencia, Bernalillo, and Sandoval are the Counties affected by the diversion and in which the water has been or will be put to beneficial use. This notice is ordered to be published in the El Defensor Chieftain, Valencia County News-Bulletin, and Albuquerque Journal.

The applicants propose to discontinue the farm delivery requirement of 4.095 acre-feet per annum (afa) of surface water, inclusive of a consumptive irrigation requirement (CIR) of 2.8665 afa, from the San Antonio Acequia, with a point of diversion located at the San Acacia Diversion Works (SP-1690-4), located at a point where X=326,225 meters and Y=3,792,219 meters, UTM, NAD83, Zone 13N, on land owned by the MRGCD, for the irrigation of 1.365 acres of land described as Family Land Division for Leandro and Rosela Gonzales, Lot 69D on MRGCD Map 176, in Section 8, Township 5 South, Range 1 East, NMPM, Socorro County. The move-from tract is owned by Darleen Denise Baca and is located approximately 0.5 mile south of the intersection of Old Highway 85 and San Antonio Road in San Antonio, Socorro County, New Mexico.

The applicants further propose to transfer stated water right of 2.8665 afa (CIR) to well RG-97542 located at a point where X=360,032 meters and Y=3,907,988 meters, UTM, NAD83, Zone 13N, for domestic, commercial, KOA campground, mobile home park and related purposes on 9.07 acres of land described as Tr. 32N (8.70 acres) on MRGCD Maps 10 & 11, within Sections 5 & 32, Townships 12 and 13 North, Range 4 East, NMPM and Tr. 1A5 (0.37 acre) on MRGCD Map 11 within Section 5, Township 12 North, Range 4 East, NMPM. The move-to lands and well RG-97542 are owned by Meadow Village Partners, LLC; Craig Terrace Partners, LLC; and Intermountain Mule Deer, LLC, and are located on South Hill Rd. approximately 0.25 mi. north of the intersection of Richardson Dr. and South Hill Rd. and 0.25 mi west of I-25 in the Town of Bernalillo, Sandoval County.

RG-97542 is currently permitted for mobile home parks use for a total diversion of 7.907 afa.

Any person, firm or corporation or other entity having standing to file objections or protests shall do so in writing (objection must be legible, signed, and include the writer’s complete name, phone number, email address, and mailing address). The objection to the approval of the application must be based on: (1) Impairment; if impairment, you must specifically identify your water rights; and/or (2) Public Welfare/Conservation of Water; if public welfare or conservation of water within the state of New Mexico, you must show how you will be substantially and specifically affected. The written protest must be filed, in triplicate, with the Office of the State Engineer, 5550 San Antonio Dr. NE, Albuquerque, NM, 87109, on or before August 13, 2021. Facsimiles (faxes) will be accepted as a valid protest if the hard copy is hand-delivered or mailed and postmarked within 24-hours of the facsimile. Mailing postmark will be used to validate the 24-hour period. Protests can be faxed to the Office of the State Engineer, 505-383-4030. If no valid protest or objection is filed, the State Engineer will evaluate the application in accordance with the provisions of Chapter 72 NMSA 1978.
