NOTICE is hereby given that on June 3, 2021, applicant Gerald Robert Gabaldon, 17 Hwy 346, Belen, NM 87002, filed Application No. SD-02915-D with the STATE ENGINEER for permit to Change Place of Use of Surface Water in the Middle Rio Grande Water Basin of the State of New Mexico.

Valencia is the county affected by the diversion and in which the water has been or will be put to beneficial use. This notice is ordered to be published in the Valencia County News-Bulletin.

The applicant proposes to discontinue the farm delivery requirement (fdr) of 4.86 acre-feet per annum (afa) of surface water, inclusive of a consumptive irrigation requirement (cir) of 3.402 afa, used for irrigation purposes, from the Casa Colorada Acequia, with a point of diversion on the Rio Grande at the Isleta Diversion Works of the MRGCD, on land owned by the Pueblo of Isleta, at a point where X=346,037 and Y=3,863,880, meters, UTM Zone 13N, NAD83 in the NE1/4 NE/14 SW1/4, Section 24, Township 8 North, Range 2 East, NMPM, Valencia County, on 1.62 ac. of land owned by Gerald Robert Gabaldon, described as the western 32′ of Tr. 6B and 6C (0.22 ac.), the west pt. of Tr. 6D and 6E1 (1.25 ac.), and a strip of land measuring 14′ by 490′ in Tr. 6C and Tr. 6D (0.15 ac.) on MRGCD Map 116, within Section 29, Township 4 North, Range 2 East, NMPM. The move-from lands are located approximately 0.25 mi. northwest of the intersection of Hwy 346 and Hwy 304 in town of Casa Colorada, Valencia County.

The applicant further proposes to transfer said surface water right of 4.86 afa fdr inclusive of 3.402 afa cir, for irrigation purposes, from the Casa Colorada Acequia, with a point of diversion on the Rio Grande at the Isleta Diversion Works of the MRGCD described above, to 1.62 ac. of land owned by Gerald Robert Gabaldon, described as the eastern pt. of Tr. 6A on MRGCD Map 116, within Section 29, Township 4 North, Range 2 East, NMPM. The move-to land is located approximately 0.28 mi. northwest of the intersection of Hwy 346 and Hwy 304 in the town of Casa Colorada, Valencia County.

Any person, firm or corporation or other entity having standing to file objections or protests shall do so in writing (objection must be legible, signed, and include the writer’s complete name, phone number, email address, and mailing address). The objection to the approval of the application must be based on: (1) Detriment; if detriment, you must specifically identify your water rights; and/or (2) Public Welfare/Conservation of Water; if public welfare or conservation of water within the state of New Mexico, you must show how you will be substantially and specifically affected. The written protest must be filed, in triplicate, with the Office of the State Engineer, 5550 San Antonio Dr. NE, Albuquerque, NM, 87109, on or before August 20, 2021. Facsimiles (faxes) will be accepted as a valid protest if the hard copy is hand-delivered or mailed and postmarked within 24-hours of the facsimile. Mailing postmark will be used to validate the 24-hour period. Protests can be faxed to the Office of the State Engineer, 505-383-4030. If no valid protest or objection is filed, the State Engineer will evaluate the application in accordance with the provisions of Chapter 72 NMSA 1978.
