NOTICE OF ADOPTION
NOTICE IS HEREBY GIVEN that the City of Belen held a public hearing during the Regular City Council Meeting that was held on Monday, , in the Belen City Hall Council Chambers, 100 South Main St., Belen, NM, 87002, in reference to the adoption of Ordinance No. 2021-13 titled and described as:
AUTHORIZING THE ISSUANCE AND SALE OF CITY OF BELEN, NEW MEXICO TAXABLE INDUSTRIAL REVENUE BONDS (SKY RANCH ENERGY STORAGE LLC PROJECT), IN A MAXIMUM PRINCIPAL AMOUNT OF UP TO $91,000,000 IN ONE OR MORE SERIES TO PROVIDE FUNDS TO FINANCE THE EQUIPPING OF AN INDUSTRIAL REVENUE BOND PROJECT FOR USE BY SKY RANCH ENERGY STORAGE LLC PROJECT OR ITS SUCCESSORS OR ASSIGNS; AUTHORIZING THE EXECUTION AND DELIVERY OF AN INDENTURE, A LEASE, A BOND PURCHASE AGREEMENT, THE BONDS AND OTHER DOCUMENTS IN CONNECTION WITH THE ISSUANCE OF THE BONDS AND THE PROJECT; AUTHORIZING A PAYMENT IN LIEU OF TAXES TO THE CITY AND BELEN CONSOLIDATED SCHOOL DISTRICT NO. 2 BY THE PROJECT COMPANIES; AND MAKING CERTAIN DETERMINATIONS AND FINDINGS RELATING TO THE BONDS AND THE PROJECT; RATIFYING CERTAIN ACTIONS TAKEN PREVIOUSLY; AND REPEALING ALL ACTIONS INCONSISTENT WITH THIS ORDINANCE.
The City of Belen Governing Body approved and adopted the above referenced, Ordinance (No. 2021-13). A copy of the full Ordinance may be reviewed at the office of the City Clerk located at 100 South Main St. Belen, NM 87002.
This Ordinance shall become effective five days after publication.
