NOTICE is hereby given that on January 19, 2022, Judy Cordova-Romero, 2300 Dietz Farm Rd., NW Albuquerque, NM 87107, and Kyle Duggins, 522 NM Highway 408, Lemitar, NM 87823, filed with the STATE ENGINEER Application No. SD-10017 into SP-5191 for Permit to Change Place of Use and Point of Diversion of Surface Water of the Rio Grande within the State of New Mexico.
Valencia County and Socorro County are the Counties affected by the diversion and in which the water has been or will be put to beneficial use. This notice is ordered to be published in The Valencia County News and El Defensor Chieftan.
The applicants propose to discontinue the Farm Delivery Requirement (FDR) of 19.68 acre-feet per annum (afa) of surface water, inclusive of a Consumptive Irrigation Requirement (CIR) of 13.776 afa from the Lemitar Lateral, with a point of diversion on the Rio Grande at the San Acacia Diversion (SP-1690-4), on land owned by the Middle Rio Grande Conservancy District (MRGCD), at a point where X=326,225 meters and Y=3,792,219 meters, UTM Zone 13N, NAD1983, from irrigation of its current place of use on land described as 6.56 acres of Parcel B, MRGCD Map 153 within Section 1, Township 2 South, Range 1 West, N.M.P.M owned by Kyle Duggins. Specifically, 5.201 acres that are portion of original Tracts 7A1B and 5A2 and 1.359 acres in a portion of original Tract 4C. The move from land is located in Lemitar, in Socorro County.
The applicant further proposes to transfer the FDR of 19.68 afa of surface water, inclusive of a CIR of 13.776 afa to the Old Jarales Acequia, with a point of diversion on the Rio Grande at the Isleta Diversion Dam (SP-1690-3), on land owned by Pueblo of Isleta, at a point where X=346,037 meters and Y=3,863,880 meters, UTM Zone 13N, NAD1983, to is new place of use on 6.56 acres of land described as Tracts 4 and 5 of MRGCD Map 106 within Section 32, Township 5 North, Range 2 East, N.M.P.M owned by Judy Cordova-Romero. No additional water is sought by this application. The move to land is located in Jarales in Valencia County.

Any person, firm or corporation or other entity asserting standing to file objections or protests shall do so in writing (objection must be legible, signed, and include the writer’s complete name, phone number, email address, and mailing address). If the protest does not include the complete name, phone number, email address, and mailing address, it may be deemed invalid and not accepted for filing unless Protestant provides with the protest an affidavit stating that it does not have one of the above-listed elements/requirements (phone number, mailing address, email address, etc.). The objection to the approval of the application must be based on: (1) Detriment; if detriment, you must specifically identify your water rights; and/or (2) Public Welfare/Conservation of Water; if public welfare or conservation of water within the state of New Mexico, you shall be required to provide evidence showing how you will be substantially and specifically affected. The written protest must be filed, in triplicate, with the State Engineer, 5550 San Antonio Dr. NE, Albuquerque, NM 87109-4127, on or before May 6, 2022. Facsimiles (faxes) will be accepted as a valid protest if the hard copy is hand-delivered or mailed and postmarked within 24-hours of the facsimile. Mailing postmark will be used to validate the 24-hour period. Protests can be faxed to the Office of the State Engineer, 505-383-4030. If no valid protest or objection is filed, the State Engineer will evaluate the application in accordance with the provisions of Chapter 72 NMSA 1978.
