NOTICE is hereby given that on March 31, 2022, Ron Oldfield, PO Box 718, Los Lunas, NM 87031, and the Village of Los Ranchos de Albuquerque, 6718 Rio Grande Blvd. NW, Los Ranchos, NM 87107, filed with the STATE ENGINEER Applications numbered SD-08830-A-A into RG-92200 for Permit to Change Point of Diversion and Place and Purpose of Use from Surface Water to Groundwater within the Rio Grande Underground Basin of the State of New Mexico.
Valencia and Bernalillo Counties are the Counties affected by the diversion and in which the water has been or will be put to beneficial use. This notice is ordered to be published in the Valencia County News-Bulletin and the Albuquerque Journal.
The co-applicants propose to discontinue the diversion and use of a farm delivery requirement (FDR) of 3.39 acre-feet per annum of surface water, inclusive of a consumptive irrigation requirement (CIR) of 2.373 acre-feet per annum from the San Fernandez Acequia, with a point of diversion on the Rio Grande at the Isleta Diversion Dam of the MRGCD, on land owned by the Pueblo of Isleta, at a point where X = 346,037 and Y = 3,863,880 meters, UTM Zone 13N, NAD83, for the irrigation of 1.13 acres of land, described as Land Division Plat of Lands of Ron Oldfield, Tract D-1 (1.0 acre) and the north part of Tract D-2 (0.13 acre) of MRGCD Maps 79 and 82, within Section 3, Township 06 North, Range 02 East, NMPM. This move-from land is owned by Ron Oldfield, and is generally located approximately 0.25 miles northwest of the intersection of Edeal Road and NM Highway 47 near Los Lunas, Valencia County, New Mexico.
The co-applicants further propose to begin the diversion of 3.39 acre-feet per annum FDR, inclusive of 2.373 acre-feet per annum CIR, described above as SD-08830-A-A, from well RG-92200 POD 4, owned by the Village of Los Ranchos, located at a point where X = 351,115 meters and Y = 3,891,234 meters intersect, UTM Zone 13N, NAD 1983, for irrigation use on 1.13 acres of land owned by the Village of Los Ranchos described as Zia Gardens Subdivision, the west part of Lot 166 (0.165 acre), a part of Lot 167 (0.475 acre) and Lot 168 (0.49 acre), MRGCD Map 29, located in Projected Section 28, Township 11 North, Range 03 East NMPM. The move-to place of use is generally located approximately 0.25 miles east of the intersection of 4th Street NW and Osuna Road NW, Los Ranchos, Bernalillo County, New Mexico.

Any person, firm or corporation or other entity asserting standing to file objections or protests shall do so in writing (objection must be legible, signed, and include the writer’s complete name, phone number, email address, and mailing address). If the protest does not include the complete name, phone number, email address, and mailing address, it may be deemed invalid and not accepted for filing unless Protestant provides with the protest an affidavit stating that it does not have one of the above-listed elements/requirements (phone number, mailing address, email address, etc.). The objection to the approval of the application must be based on: (1) Impairment; if impairment, you must specifically identify your water rights; and/or (2) Public Welfare/Conservation of Water; if public welfare or conservation of water within the state of New Mexico, you shall be required to provide evidence showing how you will be substantially and specifically affected. The written protest must be filed, in triplicate, with the State Engineer, 5550 San Antonio Dr. NE, Albuquerque, NM 87109, on or before Friday, July 22, 2022. Facsimiles (faxes) will be accepted as a valid protest if the hard copy is hand-delivered or mailed and postmarked within 24-hours of the facsimile. Mailing postmark will be used to validate the 24-hour period. Protests can be faxed to the Office of the State Engineer, 505-383-4030. If no valid protest or objection is filed, the State Engineer will evaluate the application in accordance with the provisions of Chapter 72 NMSA 1978.
