NOTICE OF SALE

Notice is given that the real property described below in Valencia County, New Mexico, will be sold to the highest bidder for cash or wire transfer on July 8, 2021, at 10:30 a.m., in front of the Valencia County Courthouse, 1835 NM-314, Los Lunas, New Mexico 87031. The sale arises out of a Default Judgment for Foreclosure and Order for Foreclosure Sale entered on May 18, 2021. The Judgment awarded to Plaintiff and against Defendant Brandon Jaramillo under the Note and Mortgage, in the amount of $459,955.12 as of May 6, 2021, plus interest as it continues to accrue thereafter at the rate of 5.75% per annum until it is fully satisfied; plus all costs, expenses of collection, attorney fees, and interest thereon, all as they accrue thereafter until there is an approved sale of the Property; plus advances by Plaintiff to protect and preserve the Property and Plaintiff’s rights and remedies under the Note and Mortgage and interest thereon, all as they accrue thereafter until there is an approved sale of the Property, plus all other fees and costs allowed by the Note and Mortgage all as they accrue thereafter until there is an approved sale of the Property, plus the Special Master’s fee of $300 plus New Mexico gross receipts tax, as compensation for his services, plus gross receipts tax and the cost of publishing the Notice of Sale. Attorneys’ fees and costs incurred to conclude this matter may be includable in the order confirming the foreclosure sale. The Judgment decrees that Plaintiff may, but is not required to, bid the money judgment, or any portion of it, as a credit against the purchase price of the Property described below in lieu of cash at the sale. The real property (the “Property”), located in Valencia County, New Mexico, is more particularly described as follows:

LOT SIX (6), LA VIDA SUERTE COUNTRY ESTATES, AS SHOWN AND SO DESIGNATED ON THE SUBDIVISION PLAT THEREOF, FILED IN THE OFFICE OF THE VALENCIA COUNTY CLERK, ON JANUARY 3, 2007, SAID PLAT BEING AMENDED SEPTEMBER 7, 2010, IN PLAT CABINET “M”, PAGE 168, RECORDS OF VALENCIA COUNTY, NEW MEXICO.

The Property has a common street address of 4 Wishbone Court, Los Lunas, New Mexico 87031 and includes all existing or subsequently erected or affixed buildings, improvements and fixtures; all easements, rights of way, and appurtenances, all water, water rights, watercourses and ditch rights (including stock in utilities with ditch or irrigation rights); and all other rights, royalties, and profits relating to the real property, including without limitation all minerals, oil, gas, geothermal and similar matters. In the event that there is a conflict between the Property’s legal description and the Property’s address, the Property’s legal description shall control.
The purchaser at the foreclosure sale shall take title to the Property free and clear of any and all claims of the parties subject, however, to the following:

A. a one month right of redemption in accordance with the Mortgage;
B. any easements, patents, restrictions, dedications, covenants of record;
C. any unpaid and owing ad valorem property taxes;
D. any municipal liens or assessments with statutory priority; and,
E. any other prior unpaid liens of record or mortgages and not foreclosed hereby.
