GREETINGS:

You are hereby notified that further action has been commenced and remains pending in the District Court of Bernalillo County, New Mexico, Colleen Adolph, as Guardian and Conservator of Amalia Kelley (“Petitioner”), is the Petitioner and you are the Respondent, said cause number being No.: D-202-CV-2021-00613 on the civil docket of said Court.

The objects and purposes of the action are to set aside the deed to Amalia Kelley’s house and for damages based on undue influence, all as more particularly prayed for, and set forth in the Petition for Undue Influence and to Set Aside Deed. You are further notified that unless you enter your appearance and respond to the July 8, 2021 Motion for Summary Judgment and Notice of Exhibit in said cause within fifteen (15) days of this service pursuant to NMRA 1-004 and NMRA 1-056 within such time, judgment by default may be rendered in said cause against you for failing to appear, and the Petitioner will apply to the Court for the relief demanded in this Motion for Summary Judgment.
