NOTICE is hereby given that on October 5, 2021, and amended on November 4, 2021, Janet Miller, 4603 Inspiration Dr. SE, Albuquerque NM 87108, and the Village of Bosque Farms, c/o Russel Walkup, Mayor, PO Box 660, Peralta, NM 87042, filed with the STATE ENGINEER Application No. (RG-47108 and RG-47108-S into RG-99171)-T for Permit under Water-Use Leasing Act (NMSA 1978, Sections 72-6-1 through -7) to Temporarily Change Point of Diversion and Place of Use of 2.0 acre-feet per annum from the following described groundwater well within the Rio Grande Underwater Basin of the State of New Mexico. Preliminary Authorization was requested and granted.

Valencia County is the County affected by the diversion and in which the water has been or will be put to beneficial use. This notice is ordered to be published in the Valencia County News-Bulletin.

The co-applicants propose to temporarily discontinue (until December 31,2025) the diversion and use of a Consumptive Use amount (CU) of 2.0 acre-feet per annum of ground water from two (2) wells under permit RG-47108, approved by the State Engineer on May 15, 1998 on land owned by the Village of Bosque Farms, with points of diversion as described: Well RG-47108, located at a point where Longitude = 106o 42′ 15.2″ W and Latitude = 34o 51′ 52.4″ N, WGS 84 and well RG-47108-S, located at a point where Longitude = 106o 41′ 30.5″ W and Latitude = 34o 50′ 41.8″ N, WGS 84, for municipal and related uses. The move-from land is described as any location within the Village of Bosque Farms, Valencia County, New Mexico. The move-from land is generally located approximately 3.75 miles northeast of Los Lunas, New Mexico.

The applicants further propose to transfer the above-described water right to domestic well RG-99171, permitted on November 20, 2020, at a point where X = 341,088 meters and Y = 3,848,809 meters intersect, UTM Zone 13N, NAD 1983. RG-99171 will be approximately 140 feet deep, and have a casing 5 inches in diameter. The consumptive use amount of 2.0 acre feet per annum transferred in this permit will be designated for irrigation and commercial use specifically described as drip irrigation within hoop houses, within approximately 0.8 acres, described as a part of Tract 3 of the re-plat of Land of Gale P. Miller, MRGCD Map 80. The move-to land and move-to well are on land owned by Janet Miller. This move-to land is generally located approximately 0.5 miles southeast of the intersection of New Mexico Highway 314 and Los Lentes Road, near Los Chavez, Valencia County, New Mexico

This application is filed under the Water-Use Leasing Act, NMSA 1978, Sections 72-6-1 through 72-6-7.

Any person, firm or corporation or other entity asserting standing to file objections or protests shall do so in writing (objection must be legible, signed, and include the writer’s complete name, phone number, email address, and mailing address). If the protest does not include the complete name, phone number, email address, and mailing address, it may be deemed invalid and not accepted for filing unless Protestant provides with the protest an affidavit stating that it does not have one of the above-listed elements/requirements (phone number, mailing address, email address, etc.). The objection to the approval of the application must be based on: (1) Impairment; if impairment, you must specifically identify your water rights; and/or (2) Public Welfare/Conservation of Water; if public welfare or conservation of water within the state of New Mexico, you shall be required to provide evidence showing how you will be substantially and specifically affected. The written protest must be filed, in triplicate, with the State Engineer, District 1 Office, located at 5550 San Antonio Drive NE, Albuquerque, NM 87109-4127, on or before Friday, January 28, 2022. Facsimiles (faxes) will be accepted as a valid protest if the hard copy is hand-delivered or mailed and postmarked within 24-hours of the facsimile. Mailing postmark will be used to validate the 24-hour period. Protests can be faxed to the Office of the State Engineer, (505) 383-4030. A copy of the written protest filed with the State Engineer must also be sent to the applicant by certified mail. If no valid protest or objection is filed, the State Engineer will evaluate the application in accordance with the provisions of Chapter 72 NMSA 1978.
