NOTICE OF SALE

NOTICE IS HEREBY GIVEN that pursuant to the Default Judgment, Decree for Foreclosure and Order of Sale ("Judgment"), enteredn on 11/24/2021, the undersigned Special Master will sell at public auction, for cash or certified funds, at the hour of 11:00 a.m. on January 5, 2022, at the main entrance of the Valencia County Courthouse, 1835 Highway SW, Los Lunas, NM 87031, the real property and improvements situated in Valencia County, New Mexico, commonly known as 1122 Los Nardos, Las Lunas, New Mexico 87031, and as more particularly described as follows:

Lot Fifty Seven (57) of Villa Escondida Phase I, as said lot is show and designated on the Plat thereof, filed in the office of the County Clerk of Valencia County, New Mexico on February 5, 1998 in Plat Cabinet J at page 199,

hereafter the "Property"). If there is any discrepancy between the Property address and the legal description, the legal description shall control.

The Property will be sold subject to rights of redemption; easements, reservations and restrictions of record; taxes and governmental assessments including unpaid utility bills; any liens or encumbrances not foreclosed in the proceeding; the valuation of the Property by the County assessor as real or personal property; environmental contamination, if any; any homeowners or condominium association declarations, rules, requirements and restrictions; any homeowners or condominium association dues, assessments, and special assessments which are not extinguished by the Judgment; any requirements imposed by city or county ordinance or by state law affecting the Property; and zoning violations concerning the Property, if any. No representation is made as to the validity of the rights of ingress and egress. Transfer of title to the highest bidder shall be without warranty or representation of any kind. ALL PROSPECTIVE PURCHASERS AT THE SALE ARE ADVISED TO MAKE THEIR OWN EXAMINATION OF TITLE AND TO CONSULT THEIR OWN ATTORNEY BEFORE BIDDING.

This action is a suit to foreclose a mortgage in favor of New Mexico Bank & Trust ("NMBT"), secured by the Property. The total amount awarded by the Judgment to NMBT with interest to the date of sale is $70,990.81, plus any amounts advanced by NMBT to protect the Property before sale, including for insurance, maintenance, taxes, assessments or other expenses relating to the Property, plus additional attorney fees and costs incurred to NMBT from and after November 1, 2021.

The proceeds from the judicial sale will be applied first to the payment of the costs and expenses of the sale; then to the payment of the Judgment in favor of NMBT, including additional fees, costs and expenses as stated in the foregoing paragraph. Any excess funds shall be deposited with the Clerk of Court to be applied as may be determined by further order of the Court. NMBT may apply all or a portion of the Judgment towards the purchase as a credit bid. Otherwise, terms of sale shall be immediately payable in cash or cashier’s check.
