NOTICE is hereby given that on January 20, 2022, co-applicants David Carrillo and Cathy D. Carrillo, P.O Box 357, Jarales, NM 87023, c/o Water Bank, 610 Gold Ave., SW, Suite, 111, Albuquerque, NM 87102, and Manzano Partners, LLC., c/o Jeffrey Sandoval, Managing Member, 8320 Wedgewood Ave. NW, Albuquerque, NM 87120, filed with the STATE ENGINEER Application No. SD-09575 into RG-A0170 POD1, for a Permit to Change the Point of Diversion and Change the Place and Purpose of Use from Surface Water to Groundwater, within the Middle Rio Grande Water Basin, of the State of New Mexico.

Valencia County and Socorro County are the Counties affected by the diversion and in which the water has been or will be put to beneficial use. This Notice is ordered to be published in the Valencia County News-Bulletin (Valencia County) and in the El Defensor Chieftain (Socorro
County).

The co-applicants propose to discontinue the diversion of 8.114 afa Farm Delivery Requirement (FDR) of surface water, inclusive of a Consumptive Use Irrigation (CIR) of 5.677 afa, for the
irrigation of 2.7038 acres of land, owned by David Carrillo and Cathy D. Carrillo, described as Tract D1A, Lands of William Giron (1.7038 acres) and Lot C, Lands of David A. Twigg (1.0
acre), located on MRGCD Map No. 104, within Valencia County, within Section 30, Township 5 North, Range 2 East, NMPM, irrigated from the Lower Arroyos Acequia, with a point of diversion on the Rio Grande at the at the Isleta Diversion Dam (SP-1690-3), on land owned by the Pueblo of Isleta, located within the Pueblo of Isleta Grant, within projected NE¼ NE¼ SW¼
of Section 24, Township 8 North, Range 2 East, NMPM, at a point where X=346,037 meters and Y=3,863,880 meters intersect, UTM Zone 13N, NAD 1983. The move-from tracts are generally located 0.25 mile west of the intersection of Audra Ct., and Jarales Rd., Belen, Valencia County, New Mexico.

The co-applicants further propose to transfer the diversion of
8.114 afa FDR, inclusive of the consumptive use amount of 5.677 afa of groundwater to well RG-A0170 POD1 (to be drilled
under Exploratory Permit No. RG-A0170 POD1 Explor., approved on December 22, 2021), on land owned by DNL, LLC., Octavio Grajeda, Managing Member, located at an approximate
point described as 106°48’16.32″ Longitude and 34°29’17.62″ Latitude, WGS84, located on MRGCD Map No. 124, within Tract B, Plat of Division of Tract 55, within projected Section 14, Township 3 North, Range 1 East, NMPM, Socorro County, New Mexico and drilled to an approximate depth of 200 feet, with a 4-inch casing, for commercial and irrigation purposes
associated with outdoor and indoor greenhouse use, appurtenant to the irrigation of 2.7038 acres total (within 9.7575 acres), owned by DNL, LLC., Octavio Grajeda, Managing Member, being the same aforementioned Tract B. The move-to well and move-to tract are generally located 1.25 mile northeast of the intersection of Calle de San Antonio and NM Highway 116, Bosque, Socorro County, New Mexico.

Upon action, this application is set to terminate and permanently replace the one year temporary lease and transfer of the same subject water rights under Application No. (SD-09575
into RG-A0170 POD1)-T, filed on November 23, 2021.

Any person, firm or corporation or other entity asserting standing to file objections or protests shall do so in writing (objection must be legible, signed, and include the writer’s complete name, phone number, email address, and mailing address). If the protest does not include the complete name, phone number, email address, and mailing address, it may be deemed invalid and not accepted for filing unless the Protestant provides with the protest an affidavit stating that it does not have one of the above-listed elements/requirements (phone number, mailing address, email address, etc.). The objection to the approval of the application must be based on: (1) Impairment; if impairment, you must specifically identify your water rights; and/or (2)
Public Welfare/Conservation of Water; if public welfare or conservation of water within the State of New Mexico, you shall be required to provide evidence showing how you will be substantially and specifically affected. The written protest must be filed, in triplicate, with the Office of the State Engineer, District 1 Office, located at 5550 San Antonio Drive NE, Albuquerque, NM 87109-4127, on or before May 3, 2022. Facsimiles (faxes) will be accepted as a valid protest if the hard copy is hand-delivered or mailed and postmarked within 24-hours of the facsimile. Mailing postmark will be used to validate the 24-hour period. Protests can be faxed to the Office of the State Engineer, (505) 383-4030. If no valid protest or objection is filed, the State Engineer will evaluate the application in accordance with the provisions of Chapter 72 NMSA 1978.
