NOTICE is hereby given that on January 24, 2022, Shady Dale Farms, LLC, c/o Janet Jarratt, 2520 Los Lentes Rd. SE, Los Lunas, NM 87031, filed Application No. RG-10326-POD2 with the STATE ENGINEER to Change Point of Diversion of Groundwater within the Middle Rio Grande Basin of the State of New Mexico.

Valencia County is the County affected by the diversion and in which the water has been or will be put to beneficial use. This notice is ordered to be published in the Valencia County News-Bulletin.

The applicant proposes to drill and commence the use of well no. RG-10326-POD2, drilled under an emergency authorization in accordance with §72-12-22 NMSA, to an approximate depth of 150 feet, with 16-inch casing, to replace existing well no. RG-10326-POD1, to be located within a 100-foot radius of said existing well, located at latitude = 34° 46′ 55.48″ and longitude = -106° 44′ 25.66″, within Section 4, Township 6 North, Range 2 East, NMPM, for the continued diversion of 330.96 acre-feet per annum (afa) Farm Delivery Requirement and 231.67 afa Consumptive Irrigation Requirement, to supplement MRGCD permits SD-0620 and SP-1690, for the irrigation of 110.32 acres described as part of two tracts described by UPC code 1009036214382000000 with a legal description of “Subd: Land of Raymond & Fenella Jarratt Tr.: 1C2B (0.93 ac), Tr. 3B (7.70 ac), Tr. 1D (17.22 ac), Tr. 5 (12.34 ac), Tr. 6 (9.59 ac), Tr. 1A2C (13.67 ac), Tr. 1A3A1 (4.88 ac), & Tr. 1E1 (9.64 ac), total 75.97 acres comb. For 1988 2013 rev.”, and UPC code 1009036275500000000 with a legal description of “Subd. Land of Raymond & Fenella Jarratt Tr. 1A2A (4.71 ac), Tr. 15 (3.40 ac), Tr. 1C1 (1.30 ac), Tr. 1C2A (14.75 ac), Tr. 3A (0.93 ac), Tr. 41 (14.14 ac), Tr. 46B (3.01 ac) total 42.24 acres Map 75 & 80 2013 Rev.”, previously described in permit no. RG-10326 as Tr. 1C (16.03 ac), Tr. 3 (7.78 ac), 1A (13.91 ac), Tr 5 (6.88 ac), Tr. 6 (8.09 ac), Tr. 1E1 (7.53 ac), Tr. 1A3A1 (3.84 ac), and Tr. 1A2 (32.49 ac) on MRGCD Map 75, and Tr. 41 (13.77 ac) on MRGCD Map 85, within Section 4, Township 6 North, Range 2 East, and Section 33, Township 7 North, Range 2 East, NMPM. Proposed well no. RG-10326-POD2 and place of use are on land owned by Shady Dale Farms, LLC and are located directly southeast of the intersection of Morris Rd. SW and Los Lentes Rd SE in Valencia County.

Any person, firm or corporation or other entity asserting standing to file objections or protests shall do so in writing (objection must be legible, signed, and include the writer’s complete name, phone number and mailing address). If the protest does not include the complete name, phone number, email address, and mailing address, it may be deemed invalid and not accepted for filing unless Protestant provides with the protest an affidavit stating that it does not have one of the above-listed elements/requirements (phone number, mailing address, email address, etc.). The objection to the approval of the application must be based on: (1) Impairment, if impairment you must specifically identify your water rights; and/or (2) Public Welfare/Conservation of Water; if public welfare or conservation of water within the state of New Mexico, you shall be required to provide evidence showing how you will be substantially and specifically affected. The written protest must be filed, in triplicate, with the Office of the State Engineer, 5550 San Antonio Dr. NE, Albuquerque, NM, 87109, on or before June 3, 2022. Facsimiles (faxes) will be accepted as a valid protest if the hard copy is hand-delivered or mailed and postmarked within 24-hours of the facsimile. Mailing postmark will be used to validate the 24-hour period. Protests can be faxed to the Office of the State Engineer, (505) 383-4030. If no valid protest or objection is filed, the State Engineer will evaluate the application in accordance with the provisions of Chapter 72 NMSA 1978.
