NOTICE OF JUDICIAL SALE

NOTICE IS HEREBY GIVEN that the undersigned Special Master will, on the 11th day of August, 2022, at 11:30 A.M., at the front door of the Valencia County District Court, 1835 NM-314, Los Lunas, New Mexico, sell and convey all of the right, title and interest of the Defendants David Garcia and Susan R. Garcia in and to the following-described real property located in Valencia County, New Mexico:

Lot D, Land of Salomon Garcia, Division of Tract 118, MRGCD Map 66, as shown on the plat thereof filed in the office of the County Clerk of Valencia County, NM on September 9, 1986 in Cabinet E, Page 53.

Sale is made pursuant to Stipulated Judgment and Default Judgment filed June 3, 2022 in the above cause, in an action to foreclose Plaintiff’s Mortgage in which Plaintiff was adjudged to have a valid first mortgage against said real property, with same to be foreclosed and sold to satisfy Plaintiff’s Judgment entered herein as follows: First, to costs of sale and Special Master fees, then to satisfy the indebtedness owed to Plaintiff in the sum of $77,592.23 plus interest at the rate of 7.50% from February 22, 2022.
Any bids in excess of the amount of Plaintiff’s Judgment shall be payable to Defendant Taxation and Revenue Department of the State of New Mexico.

That the Plaintiff named above shall be permitted to be a Purchaser at such sale and use its Judgment, or any part thereof, plus all costs, penalty and interest accrued thereon, as a credit on its bid. No bid of real property will be accepted. All bids must be in cash or certified funds.

Such sale is subject to Defendant David Garcia and Susan R. Garcia’s 30 day Right of Redemption in the above-described property.
