NOTICE is hereby given that on August 11, 2022, and August 15, 2022, co-applicants Betty Jo Sanchez, Trustee of the Betty Jo Grijalva Sanchez Trust, P.O. Box 457, Pecos, NM 87552, Jaramillo Vineyards, LLC, a NM limited liability company, contact: Robert C. Jaramillo, 30 Camino Nopales, Belen, NM 87002, Mark M. Sanchez, Trustee of the Sanchez Family Trust, Box 121, Bosque, NM 87006, and Milton & Henrietta Sanchez Family Limited Partnership, contact: Mark M. Sanchez P.O. Box 121, Bosque, NM 87006, filed Application No. SD-07262 into RG-80444 with the STATE ENGINEER for Permit to Change the Point of Diversion, Place and Purpose of Use from Surface Water to Groundwater within the Rio Grande Basin, in the State of New Mexico.

Valencia County is the County affected by the diversion and in which the water has been or will be put to beneficial use. This notice is ordered to be published in the Valencia County News-Bulletin (Valencia County).

The co-applicants propose to discontinue the diversion of a farm delivery requirement (FDR) of 29.712 acre-feet per annum of Surface Water, inclusive of a consumptive irrigation requirement (CIR) of 20.7984 acre-feet per annum, for the irrigation of 9.904 acres of land, owned by Betty Jo Sanchez, Trustee of the Betty Jo Grijalva Sanchez Trust, and Mark M. Sanchez, Trustee of the Sanchez Family Trust and Personal Representative of the Milton and Henrietta Sanchez Family Limited Partnership, described as the Lands of Gillie Sanchez, Tract B within MRGCD Map 87, within Valencia County, within Section 19, Township 6 North, Range 2 East, NMPM, irrigated from the New Belen Acequia, with a point of diversion on the Rio Grande at the Isleta Diversion Dam (SP-1690-3), on land owned by the Pueblo of Isleta, located within the Pueblo of Isleta Grant, within projected NE¼ NE¼ SW¼ of Section 24, Township 8 North, Range 2 East, NMPM, at a point where X = 346,037 meters and Y = 3,863,880 meters intersect, UTM Zone 13N, NAD 1983. The move-from land is located generally west of S Miller Road and east of Teodoro Road, Los Lunas, Valencia County, New Mexico.

The co-applicants further proposes to transfer said water right and commence diversion of a FDR of 29.712 acre-feet per annum, inclusive of a CIR of 20.7984 acre-feet per annum, from Groundwater Well RG-80444 POD1, with an approximate depth of 340 feet, with an outside diameter of well casing of 6 inches, at a point of diversion located within 50 feet of the intersection of where X = 336,686 meters and Y = 3,843,535 meters, UTM Zone 13N, NAD83, for commercial purposes including drip irrigation for a vineyard, on 13.755 acres of land described as Tract A of the Exempt Consolidation Replat of the Land of Robert C. Jaramillo and Barbara J. Jaramillo, which is part of the Nicolas Duran de Chavez Grant, within MRGCD Map 91, land and well owned by Robert C. Jaramillo and Barbara J. Jaramillo, within Valencia County, Section 25, Township 6 North, Range 1 East, NMPM. The move-to lands are located at 30 Camino Nopales, Belen, New Mexico, generally located south of Palomino Lane, east of Highline Canal, and west of the New Belen Acequia, Belen, Valencia County, New Mexico.

Any person, firm or corporation or other entity having standing to file objections or protests shall do so in writing (objection must be legible, signed, and include the writer’s complete name, phone number, email address, and mailing address). The objection to the approval of the application must be based on: (1) Impairment; if impairment, you must specifically identify your water rights; and/or (2) Public Welfare/Conservation of Water; if public welfare or conservation of water within the state of New Mexico, you must show how you will be substantially and specifically affected. The written protest must be filed, in triplicate, with the State Engineer, 5550 San Antonio Dr. NE, Albuquerque, NM 87109, on or before Friday, November 18, 2022. Facsimiles (faxes) will be accepted as a valid protest if the hard copy is hand-delivered or mailed and postmarked within 24-hours of the facsimile. Mailing postmark will be used to validate the 24-hour period. Protests can be faxed to the Office of the State Engineer, 505-383-4030. If no valid protest or objection is filed, the State Engineer will evaluate the application in accordance with the provisions of Chapter 72 NMSA 1978.
