NOTICE is hereby given that on August 12, 2022 and September 20 and 27, 2022, Herman G. Sanchez Jr., 73-A Monica Rd., Los Lunas, NM 87031, and Country Boy Cannabis RX, Agent: Jerry Sanchez, 73-A Monica Rd., Los Lunas, NM 87031, filed with the STATE ENGINEER Application No. (SD-08505-A into RG-58722)-T for Permit to Temporarily Change Purpose of Use and Point of Diversion of Surface Water of the Rio Grande Stream System into a Groundwater Point of Diversion within the State of New Mexico under Water Use Lease, NMSA 1978 72-6-1 through 72-6-7.

Valencia County is the county affected by the diversion and in which the water has been or will be put to beneficial use. This notice is ordered to be published in the Valencia County News- Bulletin.

Under this application, per lease agreement under NMSA 1978 Section 76-6-1, the applicant proposes to temporarily discontinue, for a period of five years, the farm delivery requirement of 0.96 acre-feet per annum (afa), inclusive of a consumptive irrigation requirement of 0.67 afa from the Peralta Ditch with a Point of Diversion (POD) located in the NE ¼ NE ¼ SW ¼ of Section 24, Township 8 North, Range 2 East, NMPM, at the Isleta Diversion Works, SP-1690-3, of the MRGCD, located at a point where X=346,037 meters, Y=3,863,880 meters, UTM (NAD83), Zone 13N, on land owned by the Pueblo of Isleta and leased to MRGCD, for the irrigation of 0.32 acre of land described as Tract C2, Land of Herman Sanchez, MRGCD Map 71, located within Section 25, Township 7 North, Range 2 East, NMPM, Valencia County, New Mexico. The above-described tract is located approximately 0.55 miles east of State Highway 47, in Los Lunas, Valencia County, New Mexico.

The applicant further proposes to temporarily transfer, for a period of five years, the above-described FDR of 0.96 afa, inclusive of a CIR of 0.67 afa, to the groundwater POD designated as RG-58722, located at a point where X=1,509,081 feet, Y=1,387,064 feet, NM Central Zone, NM State Plane (NAD83), for commercial irrigation and outdoor microgrow operations within the same 0.32 acre of land described above. The above-described land and well are owned by the applicant, Herman G Sanchez Jr.

This Application is filed under the Water-Use Leasing Act, NMSA 1978, Sections 72-6-1 through 72-6-7.

Any person, firm or corporation or other entity asserting standing to file objections or protests shall do so in writing (objection must be legible, signed, and include the writer’s complete name, phone number, email address, and mailing address). If the protest does not include the complete name, phone number, email address, and mailing address, it may be deemed invalid and not accepted for filing unless Protestant provides with the protest an affidavit stating that it does not have one of the above-listed elements/requirements (phone number, mailing address, email address, etc.). The objection to the approval of the application must be based on: (1) Detriment; if detriment, you must specifically identify your water rights; and/or (2) Public Welfare/Conservation of Water; if public welfare or conservation of water within the state of New Mexico, you shall be required to provide evidence showing how you will be substantially and specifically affected. The written protest must be filed, in triplicate, with the State Engineer, 5550 San Antonio Drive NE, Albuquerque, NM 87109, on or before December 30, 2022. Facsimiles (faxes) will be accepted as a valid protest if the hard copy is hand-delivered or mailed and postmarked within 24-hours of the facsimile. Mailing postmark will be used to validate the 24-hour period. Protests can be faxed to the Office of the State Engineer, (505) 383-4030. If no valid protest or objection is filed, the State Engineer will evaluate the application in accordance with the provisions of Chapter 72 NMSA 1978.
