NOTICE is hereby given that on June 1, 2022 and amended on August 3, 2022, and amended on August 8, 2022, co-applicants, Zia Trust, Larry Caid, Trustee, 8531 Flying B Way, Apt. 309, Highlands Ranch, CO 80129, c/o Water Bank, 610 Gold Ave., SW, Suite, 111, Albuquerque, NM 87102, and Trees of Corrales, Ltd., Courtenay Koontz, General Manager, P.O Box 1326, Corrales, NM 87048, c/o Water Bank, 610 Gold Ave., SW, Suite, 111, Albuquerque, NM 87102, filed Application No. (RG-01811-AD into RG-A0187 POD1)-T, for a Permit under the Water Use Leasing Act (NMSA 1978, Sections 72-6-1 to 72-6-7) to Temporarily Change the Point of Diversion and Change the Place and Purpose of Use of Groundwater, being the diversion of 10.00 acre-feet per annum (afa) Consumptive Use, within the Middle Rio Grande Water Basin, of the State of New Mexico.

Also on June 1, 2022 and amended on August 3, 2022, and amended on August 8, 2022, the same co-applicants, filed separate Application No. (RG-01811-AD-A into RG-74539 et. al.)-T for a Permit under the Water Use Leasing Act (NMSA 1978, Sections 72-6-1 to 72-6-7) to Temporarily Change the Point of Diversion and Change the Place and Purpose of Use of Groundwater, being the diversion of 42.00 acre-feet per annum (afa) Consumptive Use, within the Middle Rio Grande Water Basin, of the State of New Mexico.

For each temporary lease application, a preliminary authorization was requested and granted.

Valencia County, Bernalillo County and Sandoval County are the New Mexico Counties affected by the diversion and in which the groundwater has been or will be put to beneficial use. This notice is ordered to be published in the Valencia County News-Bulletin (Valencia County) and in the Albuquerque Journal (Bernalillo and Sandoval Counties).

Under Application No. (RG-01811-AD into RG-A0187 POD1)-T, the co-applicants propose to temporarily discontinue (commencing August 31, 2022 and ending June 6, 2029), the diversion/Consumptive Use amount of 10.0 acre-feet per annum of Licensed groundwater rights (License No. RG-01811-A), owned by Zia Trust, Larry Caid, Trustee, for the irrigation of a golf course and related purposes within 127.64 acres of land, owned by T Three, LLC, described as the Tierra Del Sol Golf Course, located within Sections 21, 22, 27 and 28, within Township 5 North, Range 2 East, NMPM, from three wells being, RG-01811 POD4, located at a point described as as where X=355,343 and Y=1,325,454 intersect, and RG-01811 POD15, located at a point described as where X=356,750 and Y=1,322,696 intersect, and RG-01811 POD24, located at a point described as where X=355,379 and Y=1,321,149, NM Central Zone, NM State Plane NAD 83, (Feet), on land owned by T Three, LLC., located within the Tierra Del Sol Golf Course, within Belen, Valencia County, New Mexico. The move-from wells and move-from place of use are generally located on the east side of the Rio Grande, between NM State Highway 304 and NM State Highway 47, Belen, Valencia County, New Mexico.

The co-applicants further propose to transfer the Consumptive Use amount of 10.0 acre-feet per annum of groundwater to proposed well RG-A0187 POD1 (drilled under Exploratory Permit No. RG-A0187 POD1, approved on December 28, 2021), on land owned by J. Courtenay Koontz and Anne M. Koontz, located at a point described as approximately where 35° 15′ 16.70?North Latitude and 106° 35′ 55.97 West Longitude intersect, WGS84, located on MRGCD Map No. 15, within Section 23, Township 12 North, Range 3 East, NMPM, for the drip irrigation of a tree farm and nursery within 9.63 acres total, owned by J. Courtenay Koontz and Anne M. Koontz, described as Tract 24, located on MRGCD Map No. 15, within Section 23, Township 12 North, Range 3 East, NMPM. The move to well and move to place of use are generally located 500 feet Southeast of the intersection of Corrales Rd., and Romero Rd., within the Village of Corrales, Sandoval County, New Mexico.

The subject 10.0 acre-feet per annum Consumptive Use water rights (RG-01811-AD) are part of Certificate and License No. RG-01811-A, granted by the State Engineer on April 22, 1991.

The co-applicants further propose to transfer the Consumptive Use amount of 42.0 acre-feet per annum of groundwater to two permitted wells, being RG-74539 POD2, located at a point described as where X=354,092 and Y=3,904,060 intersect and RG-74539 POD3, located at a point described as where X=354,237 and Y=3,904,012 intersect, UTM Zone 13 North, NAD83 (meters), located on MRGCD Map No. 14, within Section 14, Township 12 North, Range 3 East, NMPM, on lands owned by Koontz Family Limited Partnership, for the drip irrigation of a tree farm and nursery, within 84.277 acres total, owned by Koontz Family Limited Partnership, described as within Tract 1A (63.157 ac.) and Tract 1B (18.00 ac.), Summary Plat of Lots 1A and 1B; Lands of Koontz Family Partnership, and Tract B1 (3.120 ac.), Lands of Jasper F. Koontz, located on MRGCD Map No. 14, within Sections 14 and 15, Township 12 North, Range 3 East, NMPM. The move to wells and move to place of use are generally located near the intersection of Corrales Rd., and Camino Del Norte Rd., in the northern portion of the Village of Corrales, Sandoval County, New Mexico.

The groundwater diverted from move to wells, RG-74539 POD2 and RG-74539 POD3 is supplemental to surface water from the MRGCD, via the Corrales Main Canal (and SP-1690-2) as the subject move to lands fall within MRGCD Permits 0620 & SP-1690.

The subject 42.0 acre-feet per annum Consumptive Use water rights (RG-01811-AD-A) are part of Certificate and License No. RG-01811-A, granted by the State Engineer on April 22, 1991.

Any person, firm or corporation or other entity asserting standing to file objections or protests shall do so in writing (objection must be legible, signed, and include the writer’s complete name, phone number, email address, and mailing address). If the protest does not include the complete name, phone number, email address, and mailing address, it may be deemed invalid and not accepted for filing unless the Protestant provides with the protest an affidavit stating that it does not have one of the above-listed elements/requirements (phone number, mailing address, email address, etc.). The objection to the approval of the application must be based on: (1) Impairment; if impairment, you must specifically identify your water rights; and/or (2) Public Welfare/Conservation of Water; if public welfare or conservation of water within the State of New Mexico, you shall be required to provide evidence showing how you will be substantially and specifically affected. The written protest must be filed, in triplicate, with the Office of the State Engineer, District 1 Office, located at 5550 San Antonio Drive NE, Albuquerque, NM 87109-4127, on or before December 29, 2022. Facsimiles (faxes) will be accepted as a valid protest if the hard copy is hand-delivered or mailed and postmarked within 24-hours of the facsimile. Mailing postmark will be used to validate the 24-hour period. Protests can be faxed to the Office of the State Engineer, (505) 383-4030. If no valid protest or objection is filed, the State Engineer will evaluate the application in accordance with the provisions of Chapter 72 NMSA 1978.
