NOTICE is hereby given that on December 28, 2022, Margaret Garcia, 1315 Montara Dr. NW, Los Lunas, NM 87031, and Village of Los Lunas, Contact: Gregory D. Martin, 660 Main St., Los Lunas, NM 87031, filed with the STATE ENGINEER Application No. SD-07061 into RG-17065 et al. for Permit to Change Place and Purpose of Use and Point of Diversion of Surface Water to Ground Water within the Rio Grande Basin of the State of New Mexico.

Valencia County and Bernalillo County are the counties affected by the diversion and in which the water has been or will be put to beneficial use. This notice is ordered to be published in the Valencia County News-Bulletin and The Albuquerque Journal.

Under this application, the applicants propose to discontinue the farm delivery requirement of 4.212 acre-feet/year, inclusive of a consumptive irrigation requirement of 2.9484 acre-feet/year of surface water under SD-07601 from the Pueblo Lateral, with a Point of Diversion (POD) on the Rio Grande at the Angostura Diversion Dam (SP-1690-2), on land owned by the MRGCD, at a point where X = 363,856 and Y = 3,916,198 meters, UTM Zone 13N, NAD83, for the irrigation of 1.404 acres of land owned by the Estate of Patrick H. Garcia, described as Tracts 66B2A & 214A1 on MRGCD Map 27, located within projected Section 20, Township 11 North, Range 3 East, NMPM, Bernalillo County, New Mexico. This move-from land is generally located 0.13 mi. southwest of the intersection of Ranchitos Rd. NW and Rio Grande Blvd. NW.

The applicants further propose to transfer the above-described consumptive irrigation requirement of 2.9484 acre-feet/year to be used for municipal, industrial, commercial, and all other uses permitted under RG-17065 et al., to seven groundwater POD locations throughout the service area of the Village of Los Lunas Municipal Water System owned by the Village of Los Lunas. Using UTM (NAD83), Zone 13N, the well locations are described as:

RG-17065, located at a point where X=338305.4, Y=3852183.4 meters, RG-17065-S, located at a point where X=341180.2, Y=3852940.1 meters, RG-17065-S-2, located at a point where X=339266.6, Y=3854556.6 meters, RG-17065-S-3, located at a point where X=339916.5, Y=3856244.8 meters, RG-17065-S-4, located at a point where X=338377.2, Y=3853956.8 meters, RG-17065-POD6, located at a point where X=338599, Y=3854659 meters, and RG-17065-POD7, located at a point where X=339261, Y=3854521 meters.

All wells are located within the San Clemente Grant, UTM (NAD83), Zone 13N, on land owned by the Village of Los Lunas. Said wells are generally located within a one-mile radius of the I-25 and SR 6 within the limits of the Village of Los Lunas, Valencia County, New Mexico.

If the protest does not include the complete name, phone number, email address, and mailing address, it may be deemed invalid and not accepted for filing unless Protestant provides with the protest an affidavit stating that it does not have one of the above-listed elements/requirements (phone number, mailing address, email address, etc.). The objection to the approval of the application must be based on: (1) Detriment; if detriment, you must specifically identify your water rights; and/or (2) Public Welfare/Conservation of Water; if public welfare or conservation of water within the state of New Mexico, you shall be required to provide evidence showing how you will be substantially and specifically affected. The written protest must be filed, in triplicate, with the State Engineer, 5550 San Antonio Drive NE, Albuquerque, NM 87109, on or before Friday, March 24, 2023. Facsimiles (faxes) will be accepted as a valid protest if the hard copy is hand-delivered or mailed and postmarked within 24-hours of the facsimile. Mailing postmark will be used to validate the 24-hour period. Protests can be faxed to the Office of the State Engineer, (505) 383-4030. If no valid protest or objection is filed, the State Engineer will evaluate the application in accordance with the provisions of Chapter 72 NMSA 1978.
