NOTICE is hereby given that on March 3, 2023, Steven A. Brown as Trustee of the Steven A. Brown Revocable Trust, 7 Vista Solano Dr., Los Lunas, New Mexico 87031, filed with the STATE ENGINEER Application No. RG-26284 POD2 for a Permit to Change Groundwater Point of Diversion in the Rio Grande Underground Water Basin in the State of New Mexico.

Valencia County is the County affected by the diversion and in which the water has been or will be put to beneficial use. This notice is ordered to be published in the Valencia County News-Bulletin.

The applicant proposes to discontinue the use of permitted well RG-26284 POD1, which is failing, located at a point where X = 341,669 and Y = 3,844,155, meters (NAD83) and commence the use of proposed replacement well RG-26284 POD2, to be located at a point where X = 341,754 and Y = 3,844,135 meters (NAD83) intersect for the continued irrigation of 7.75 acres of land described as Tracts 1A, 1B, and 1C Division Plat of Tract 1, Lands of John Carlberg on MRGCD Map 88. The move-from and move-to wells and place of use are all on land owned by the applicant and generally located in Section 22, Township 6N, Range 2E, NMPM, approximately at the northeast corner of Highway 47 and Vista Solano in Los Lunas, Valencia County, NM.

Replacement well RG-26284 POD2 will be supplemental to surface water rights at all times, for the combined diversion of 23.25 acre-feet per annum (AFA) from all sources. No new appropriation of water above the applicants’ right to divert up to 23.25 AFA under Permit RG-26284 is requested by this Application, and the applicant seeks to continue to divert groundwater for irrigation purposes.

Any person, firm or corporation or other entity asserting standing to file objections or protests shall do so in writing (objection must be legible, signed, and include the writer’s complete name, phone number, email address, and mailing address). If the protest does not include the complete name, phone number, email address, and mailing address, it may be deemed invalid and not accepted for filing unless Protestant provides with the protest an affidavit stating that it does not have one of the above-listed elements/requirements (phone number, mailing address, email address, etc.). The objection to the approval of the application must be based on: (1) Impairment; if impairment, you must specifically identify your water rights; and/or (2) Public Welfare/Conservation of Water; if public welfare or conservation of water within the state of New Mexico, you shall be required to provide evidence showing how you will be substantially and specifically affected. The written protest must be filed, in triplicate, with the State Engineer, District 1 Office, located at 5550 San Antonio Drive NE, Albuquerque, NM 87109-4127, on or before Friday, July 14, 2023. Facsimiles (faxes) will be accepted as a valid protest if the hard copy is hand-delivered or mailed and postmarked within 24-hours of the facsimile. Mailing postmark will be used to validate the 24-hour period. Protests can be faxed to the Office of the State Engineer, (505) 383-4030. A copy of the written protest filed with the State Engineer must also be sent to the applicant by certified mail. If no valid protest or objection is filed, the State Engineer will evaluate the application in accordance with the provisions of Chapter 72 NMSA 1978.
