NOTICE is hereby given that on September 16, 2020, James A. and Cynthia M. Demick, 43 Chughole Lane, Peralta, New Mexico, 87042, filed Application No. RG-66289 with the STATE ENGINEER to Change Location of Well within the Middle Rio Grande Water Basin of the State of New Mexico. Valencia County is the County affected by the diversion and in which the water has been or will be put to beneficial use. This notice is ordered to be published in the Valencia County News-Bulletin. The applicants propose to replace existing well RG-66289 (POD1) with the drilling and use of replacement well RG-66289 POD2 within 25 feet of said existing well RG-66289 (POD1) located approximately at Latitude 34° 47′ 54″ North and Longitude 105° 41′ 19″ West, both located within Tract C-1 of plat of “Cynthia M. and James A. Demick”, MRGCD Map 71, in the SE ¼ SW ¼ SW ¼ of Section 25, Township 7 North and Range 2 East, NMPM, under Emergency Authorization (72-12-22 NMSA 1978), issued September 14, 2020, to be drilled with the original specifications of RG-66289 POD1 to a depth of 240 feet deep, with 5.5 inch casing, for a continued diversion that shall not exceed 1.77 acre-feet per annum for domestic, sanitary and related purposes for mobile home park, with a place of use described as JC Mobile Home Park comprised of 3.226 acres of land described as Tracts A1 thru A4, B1 thru B4, C1 thru C3 and 28E2A, of plat of “Cynthia M. and James A. Demick”, within MRGCD Map 71, within said Section 25. The wells and place of use are located on land owned by the applicants and are located approximately 0.65 miles east of the intersection of State Highway 47 and El Cerro Loop in Valencia County, New Mexico. No new appropriations are requested under this application. Any person, firm or corporation or other entity having standing to file objections or protests shall do so in writing (objection must be legible, signed, and include the writer’s complete name, phone number and mailing address). The objection to the approval of the application must be based on: (1) Impairment; if impairment, you must specifically identify your water rights; and/or (2) Public Welfare/Conservation of Water; if public welfare or conservation of water within the state of New Mexico, you must show how you will be substantially and specifically affected. The written protest must be filed, in triplicate, with the State Engineer, 5550 San Antonio Dr. NE, 87109, by the December 4, 2020. Facsimiles (505-383-4030) will be accepted as a valid protest as long as the hard copy is hand-delivered or mailed and postmarked within 24-hours of the facsimile. Mailing postmark will be used to validate the 24-hour period. Protests can be faxed to the Office of the State Engineer, (505-383-4030). If no valid protest or objection is filed, the State Engineer will evaluate the application in accordance with the provisions of Chapter 72 NMSA 1978.
