NOTICE is hereby given that on April 22, 2024, and on May 15, 2024 (amended), Duke City Redi-Mix, LLC, c/o Miles Shiver III, PO Box 9710, Albuquerque, NM 87119, with Shiver Redi-Mix, LLC, c/o Miles Shiver III, PO Box 9710, Albuquerque, NM 87119, filed Application No. (RG-76793 into RG-A1834)-T with the STATE ENGINEER for Permit to Temporarily Change Place of Use and Point of Diversion of Groundwater within the Rio Grande Basin of the State of New Mexico. Bernalillo County and Valencia County are the counties affected by the diversion and in which the water has been or will be put to beneficial use. This notice is ordered to be published in the Albuquerque Journal and the Valencia County News-Bulletin. The applicants propose to temporarily discontinue from May 15, 2024, to May 15, 2034, the consumptive use (cu) of 5.0 acre-feet per annum (afa) from well RG-76793 POD1 located at a point where latitude = 34 58 51.33 and longitude = -106 39 24.73, currently used for industrial, sand and gravel operation, and related purposes, on 28.48 acres of land, described as Tract B4 of Platbook 95C of Folio 269 of Lands of Norenberg & Magatagan, in Section 30, Township 9 North, Range 3 East, NMPM. The move-from well and land are owned by Duke City Redi-Mix, LLC, and are generally located 0.6 mile south of the intersection of Desert Rd. SE and Broadway Blvd SE on the west side of Broadway Blvd SE, in the City of Albuquerque, Bernalillo County. The applicants further propose to commence the above-described diversion of 5.0 afa consumptive use, for the above-described ten years, from proposed well no. RG-A1834 POD1, to be located within 100 ft. of a point where latitude = 34 47 9.34 and longitude = -106 40 18.04, to be used for industrial, sand and gravel operation, and related purposes, within 250.48 acres of land described as 144.2 acres being Lot Two-A (2A) of Replat of Tract Two (106.28 acres), and Lots 3 and 4 (one tract, 144.2 acres), all lots of Lands of Orona Investments, located within Section 31, Township 7 North, Range 3 East, and Section 6, Township 6 North, Range 3 East, NMPM. The move-to lands and location of the proposed well are owned by Shiver Redi-Mix, LLC, and are generally located directly east of the intersection of Carrasco Rd and El Cerro Loop near the Village of Los Lunas in Valencia County. Any person, firm or corporation or other entity asserting standing to file objections or protests shall do so in writing (objection must be legible, signed, and include the writers complete name, phone number, email address, and mailing address). If the protest does not include the complete name, phone number, email address, and mailing address, it may be deemed invalid and not accepted for filing unless Protestant provides with the protest an affidavit stating that it does not have one of the above-listed elements/requirements (phone number, mailing address, email address, etc.). The objection to the approval of the application must be based on: (1) Impairment; if impairment, you must specifically identify your water rights; and/or (2) Public Welfare/Conservation of Water; if public welfare or conservation of water within the state of New Mexico, you shall be required to provide evidence showing how you will be substantially and specifically affected. The written protest must be filed, in triplicate, with the State Engineer, Insert District Mailing Address here, on or before July 26, 2024. Facsimiles (faxes) will be accepted as a valid protest if the hard copy is hand-delivered or mailed and postmarked within 24-hours of the facsimile. Mailing postmark will be used to validate the 24-hour period. Protests can be faxed to the Office of the State Engineer, Insert District fax number here. If no valid protest or objection is filed, the State Engineer will evaluate the application in accordance with the provisions of Chapter 72 NMSA 1978.
