Further, on August 10th, 2021, co-applicants Charlotte and Jose Salazar, c/o WaterBank, 610 Gold Avenue SW Suite 111, Albuquerque, NM 87102 and Lisa Bealhen, c/o WaterBank, 610 Gold Avenue SW Suite 111, Albuquerque, NM 87102, filed with the STATE ENGINEER Application No. SD-07174 into SD-08355 for Permit to Change Point of Diversion and Place and Purpose of Use from Surface Water to Surface Water within the Middle Rio Grande Conservancy District of the State of New Mexico.

Bernalillo and Valencia Counties are the Counties affected by the diversion and in which the water has been or will be put to beneficial use. This notice is ordered to be published in the Valencia County News-Bulletin and the Albuquerque Journal.

Ann C. de Baca, Trustee of the Ann C’de Baca Revocable Trust and Charlotte and Jose Salazar propose to discontinue the diversion and use of a farm delivery requirement (FDR) of 3.06 acre-feet per annum of surface water, inclusive of a consumptive irrigation requirement (CIR) of 2.142 acre-feet per annum, from the Arenal Lateral, with a point of diversion on the Rio Grande at the Angostura Diversion Dam (SP-1690-2), at a point where X = 363,856 meters and Y = 3,916,198 meters intersect, UTM Zone 13N, NAD 1983, for the irrigation of 1.02 acres of land. The move-from land is described as tracts 108-A (0.8 ac.) and 115-A (0.22 ac.). The move-from tracts are found on MRGCD map 42, within Projected Section 26, Township 10 North, Range 2 East, NMPM. This move-from land is generally located approximately 0.25 mi. northwest of the intersection of Atrisco Drive and Rosendo Garcia Road in Albuquerque, Bernalillo County, New Mexico.

Further, Lisa Bealhen and Charlotte and Jose Salazar propose to discontinue the diversion and use of a farm delivery requirement (FDR) of 1.29 acre-feet per annum of surface water, inclusive of a consumptive irrigation requirement (CIR) of 0.903 acre-feet per annum, from the Harman Lateral, with a point of diversion on the Rio Grande at the Angostura Diversion Dam (SP-1690-2), at a point where X = 366,225 meters and Y = 3,792,219 meters intersect, UTM Zone 13N, NAD 1983, for the irrigation of 0.43 acre of land. The move-from land is described as all of Lot 3 (0.25 ac.) and portions of lots 9 (0.03 ac.) and 13 (0.15 ac.) of the Vista Fiasan Subdivision. The move-from tracts are found on MRGCD map 32, within Projected Section 32, Township 11 North, Range 3 East, NMPM. This move-from land is generally located approximately 0.70 miles northwest of the intersection of Montaño Road and Fourth Street in Albuquerque, Bernalillo County, New Mexico.

The applicants further propose to transfer the above-described water rights to the northwest corner and south half portions of the property described as Tract B-5-35 of the Lands of Michael Postlethwait, also known as Tract A of MRGCD map 76 for irrigation use on 1.45 acres. The move-to land is on land owned by Charlotte and Jose Salazar (applicants). This move-to land is generally located approximately 0.75 mile northeast of the intersection of N.M. Highways 47 and 263, near Los Lunas, Valencia County, New Mexico

Any person, firm or corporation or other entity having standing to file objections or protests shall do so in writing (objection must be legible, signed, and include the writer’s complete name, phone number, email address, and mailing address). The objection to the approval of the application must be based on: (1) Impairment; if impairment, you must specifically identify your water rights; and/or (2) Public Welfare/Conservation of Water; if public welfare or conservation of water within the state of New Mexico, you must show how you will be substantially and specifically affected. The written protest must be filed, in triplicate, with the State Engineer, 5550 San Antonio Dr. NE, Albuquerque, NM 87109, on or before November 12th, 2021. Facsimiles (faxes) will be accepted as a valid protest if the hard copy is hand-delivered or mailed and postmarked within 24-hours of the facsimile. Mailing postmark will be used to validate the 24-hour period. Protests can be faxed to the Office of the State Engineer, 505-383-4030. If no valid protest or objection is filed, the State Engineer will evaluate the application in accordance with the provisions of Chapter 72 NMSA 1978.
