NOTICE is hereby given that on December 23, 2021, and amended on January 24, 2022, Hays Hammond LLC., c/o Gary Hays, 4800 Osuna NE, Albuquerque, New Mexico 87109, filed Application No. RG-29439 POD7 with the STATE ENGINEER for a Permit to Add an Additional Groundwater Point of Diversion within the Middle Rio Grande Underground Water Basin within the State of New Mexico.

Valencia County is the New Mexico County affected by the diversion and in which the water has been or will be put to beneficial use. This notice is ordered to be published in the Valencia County News-Bulletin (Valencia County).

The applicant proposes to drill and commence using supplemental well RG-29439 POD7, drilled to an approximate depth of 200 feet, with a 6-inch casing, on land owned by Hays Hammond, LLC., located at a point described as approximately where X=302,660 meters and Y=3,869,674 meters intersect, UTM Zone 13 North, NAD 83, further described as located within Lot 157, Block C, Unit 8, within the Highland Meadows Estates Subdivision, within Section 4, Township 8 North, Range 3 West, NMPM, within Valencia County, Laguna, New Mexico.

Proposed well RG-29439 POD7 shall supplement two other existing permitted wells, being well RG-29439 POD5 (RG-29439-A), located at a point described as where X=302,801 meters and Y=3,869,380 meters intersect, UTM Zone 13 North, NAD 83, on land owned by Hays Hammond, LLC., further described as located within Lot 32, Block C, Unit 8, within the Highland Meadows Estates Subdivision, within Section 4, Township 8 North, Range 3 West, NMPM, and well RG-29439 POD6 (RG-29439-A-S), located at a point described as where X=303,127 meters and Y=3,869,150 meters intersect, UTM Zone 13 North, NAD 83, on land owned by Hays Hammond, LLC., further described as located within Lot 18, Block C, Unit 8, within the Highland Meadows Estates Subdivision, within Section 4, Township 8 North, Range 3 West, NMPM, for the continued total combined diversion from all said wells not to exceed the maximum permitted amount of 82.6 acre-feet per annum, consumptive use, for subdivision and related purposes of use, within 200 acres of land, owned by Hays Hammond, LLC., and numerous other owners, within the Highland Meadows Estates Subdivision, within Section 4, Township 8 North, Range 3 West, NMPM, within Valencia County, Laguna, New Mexico.

No increase in the permitted diversion and consumptive use amount of 82.6 acre-feet per annum is requested by this application.

Any person, firm or corporation or other entity having standing to file objections or protests shall do so in writing (objection must be legible, signed, and include the writer’s complete name, phone number, email address, and mailing address). The objection to the approval of the application must be based on: (1) Impairment; if impairment, you must specifically identify your water rights; and/or (2) Public Welfare/Conservation of Water; if public welfare or conservation of water within the state of New Mexico, you must show how you will be substantially and specifically affected. The written protest must be filed, in triplicate, with the State Engineer, District 1 Office, 5550 San Antonio Drive NE, Albuquerque, NM 87109, by April 22, 2022. Facsimiles (faxes) will be accepted as a valid protest if the hard copy is hand-delivered or mailed and postmarked within 24-hours of the facsimile. Mailing postmark will be used to validate the 24-hour period. Protests can be faxed to the Office of the State Engineer, District 1 Office, (505) 383-4030. If no valid protest or objection is filed, the State Engineer will evaluate the application in accordance with the provisions of Chapter 72 NMSA 1978.
