NOTICE is hereby given that on March 21, 2023, Florence Ann Dollahite, 2016 Don Pasqual Rd NW, Los Lunas, New Mexico 87031 and Elizabeth Autry, 2152 Blue Moon Ave, Los Lunas, New Mexico 87031, filed Application No. (RG-8969-A into SP-5205)-T with the STATE ENGINEER for Permit under the Water Use Leasing Act (NMSA 1978, Sections 72-6-1 to72-6-7), to Temporarily Change the Point of Diversion and Place of Use from Groundwater to Surface Water within the Middle Rio Grande Water Basin. Preliminary approval was requested and granted.

Valencia County is the County affected by the diversion and in which the water has been or will be put to beneficial use. This notice is ordered to be published in the Valencia County News-Bulletin (Valencia County).

The co-applicants propose to temporarily discontinue (for a period of time commencing immediately and ending on October 31, 2032), the diversion of 6.9615 acre-feet per annum (afa) of consumptive use groundwater rights from well Permitted under RG-8969 POD2, located at a point described as Longitude= 106º 44′ 5.24″ and Latitude= 34º 49′ 53.38″, Lat/Long, WGS84, located on land owned by Florence Ann Dollahite, for drip irrigation purposes on 3.315 acres described as part of Tract C1A1, MRGCD map 68. The move from well and place of use are generally located east of Don Pasqual Rd. and south of Silver Lane, Los Lunas, Valencia County, New Mexico.

The co-applicants further propose to temporarily commence (for a period of time commencing immediately and ending on October 31, 2032) the diversion of 9.945 afa farm delivery requirement of surface water inclusive of a consumptive irrigation requirement of 6.9615 afa from the Los Lunas Acequia, with a point of diversion on the Rio Grande at the Isleta Diversion Dam (SP-1690-3), on land owned by the Isleta Pueblo, located at a point where X=346,037 meters and Y=3,863,880 meters, UTM Zone 13 North (NAD 83), for the irrigation of 3.315 acres of land, owned by Kyle and Elizabeth Autry, described as part of Tract 7A1, located on MRGCD Map No. 68. The move-to lands are generally located east of Highway 314 NW, and between Griego Rd. and Blaylock St NE, Valencia County, New Mexico.

The surface water rights appurtenant to the subject move-to lands were previously transferred under SD-06393 into RG-6745.

This application is filed under the Water-Use Leasing Act, NMSA 1978, Sections 72-6-1 through 72-6-7, and is a temporary change. No new appropriation of water is sought by this application. Application is made for a permit that, if granted, would expire on October 31, 2032. Upon termination or expiration of the desired permit, the subject water right will automatically revert to the original move-from point of diversion and place of use.

Any person, firm or corporation or other entity asserting standing to file objections or protests shall do so in writing (objection must be legible, signed, and include the writer’s complete name, phone number, email address, and mailing address). If the protest does not include the complete name, phone number, email address, and mailing address, it may be deemed invalid and not accepted for filing unless the Protestant provides with the protest an affidavit stating that it does not have one of the above-listed elements/requirements (phone number, mailing address, email address, etc.). The objection to the approval of the application must be based on: (1) Detriment; if detriment, you must specifically identify your water rights; and/or (2) Public Welfare/Conservation of Water; if public welfare or conservation of water within the State of New Mexico, you shall be required to provide evidence showing how you will be substantially and specifically affected. The written protest must be filed, in triplicate, with the Office of the State Engineer, District 1 Office, located at 5550 San Antonio Drive NE, Albuquerque, NM 87109-4127, on or before June 16, 2023. Facsimiles (faxes) will be accepted as a valid protest if the hard copy is hand-delivered or mailed and postmarked within 24-hours of the facsimile. Mailing postmark will be used to validate the 24-hour period. Protests can be faxed to the Office of the State Engineer, (505) 383-4030. If no valid protest or objection is filed, the State Engineer will evaluate the application in accordance with the provisions of Chapter 72 NMSA 1978.
