NOTICE is hereby given that on November 20, 2023 and amended on December 5, 2023, The Village of Los Lunas, c/o Gregory D. Martin, 660 Main St., Los Lunas, NM 87031 and Tondre Estates Irrigation Association, c/o Anthony Williams, 176 Joseph Court, Los Lunas, NM 87031, filed Application No. (RG-17065 Enlgd. into SD-03856)-T-2 with the STATE ENGINEER for Permit under the Water Use Leasing Act (NMSA 1978, Sections 72-6-1 to 72-6-7), to Temporarily Change the Point of Diversion, Purpose of Use and Place of Use from Groundwater to Surface Water within the Middle Rio Grande Water Basin.

Valencia County is the County affected by the diversion and in which the water has been or will be put to beneficial use. This notice is ordered to be published in the Valencia County News-Bulletin (Valencia County).

The co-applicants propose to temporarily discontinue (commencing on a date of approval from the State Engineer and ending on December 31, 2033), the consumptive use amount of 12.684 acre-feet per annum (afa) of groundwater from seven (7) wells permitted under RG-17065 Enlgd. Said seven (7) wells, previously noticed and described, are all located on lands owned by the Village of Los Lunas, within the San Clemente Grant, and are generally located within a one-mile radius of Interstate 25 and NM State Highway 6, within the limits of the Village of Los Lunas, for municipal, industrial and commercial purposes of use on lands within the Village of Los Lunas municipal water system service area, owned by various owners, within Los Lunas, Valencia County, New Mexico.

The co-applicants further propose to temporarily transfer the diversion of 18.12 afa Farm Delivery Requirement (FDR) of surface water, inclusive of the consumptive use amount of 12.684 afa, from the Belen Acequia with a point of diversion on the Rio Grande at the Isleta Diversion Works (SP-1690-3), on land owned by the Pueblo of Isleta, located within the Pueblo of Isleta Grant, within projected NE¼ NE¼ SW¼ of Section 24, Township 8 North, Range 2 East, NMPM, at a point described as X=346,037 meters and Y=3,863,880 meters, UTM Zone 13N, NAD 1983, for the irrigation of 6.04 acres of land, owned by Anthony Williams, Stephanie Williams, Allen Sanchez, Carolina Sanchez, Stuart Maxon, Donna Maxon and Stephen Montoya (collectively being the Tondre Estates Irrigation Association), described as Lots 1, 2, 3, 4 and 5 as shown and designated on Plat Showing Land Division in Settlement of Estate of Ruth P. Tondre, recorded in the Valencia County Records on December 18, 1997 in Cabinet K, No. 305, located on MRGCD Map 69, within Section 21, Township 7 North, Range 2 East, NMPM. The move-to tracts are generally located west of the intersection of Joseph Court and NM State Highway 314, Los Lunas, Valencia County, New Mexico.

The surface water rights appurtenant to the subject move-to lands were previously severed under Permit No. SD-03856 into RG-17065, approved by the State Engineer on October 30, 1998. The subject application is requesting a renewal of Temporary Lease Permit No. (RG-17065 Enlgd. into SD-03856)-T, approved by the State Engineer on October 22, 2013, which will expire on December 31, 2023.

Any person, firm or corporation or other entity asserting standing to file objections or protests shall do so in writing (objection must be legible, signed, and include the writer’s complete name, phone number, email address, and mailing address). If the protest does not include the complete name, phone number, email address, and mailing address, it may be deemed invalid and not accepted for filing unless the Protestant provides with the protest an affidavit stating that it does not have one of the above-listed elements/requirements (phone number, mailing address, email address, etc.). The objection to the approval of the application must be based on: (1) Detriment; if detriment, you must specifically identify your water rights; and/or (2) Public Welfare/Conservation of Water; if public welfare or conservation of water within the State of New Mexico, you shall be required to provide evidence showing how you will be substantially and specifically affected. The written protest must be filed, in triplicate, with the Office of the State Engineer, District 1 Office, located at 5550 San Antonio Drive NE, Albuquerque, NM 87109-4127, on or before February 26, 2024. Facsimiles (faxes) will be accepted as a valid protest if the hard copy is hand-delivered or mailed and postmarked within 24-hours of the facsimile. Mailing postmark will be used to validate the 24-hour period. Protests can be faxed to the Office of the State Engineer, (505) 383-4030. If no valid protest or objection is filed, the State Engineer will evaluate the application in accordance with the provisions of Chapter 72 NMSA 1978.
