Notice is hereby given of the adoption and approval of an ordinance by the City Council of the City of Belen, New Mexico on April 17, 2023. Signed copies of the ordinance are available for a public inspection during normal and regular business hours in the office of the City Clerk at 100 S. Main St., Belen, New Mexico 87002.

AN ORDINANCE
AUTHORIZING THE ISSUANCE AND SALE OF CITY OF BELEN, NEW MEXICO TAXABLE INDUSTRIAL REVENUE BOND (ARCOSA WIND TOWERS, INC. PROJECT), SERIES 2023 IN A MAXIMUM PRINCIPAL AMOUNT OF UP TO $65,000,000 TO PROVIDE FUNDS TO FINANCE THE ACQUISITION, CONSTRUCTION, RENOVATION, REFURBISHMENT, EQUIPPING AND INSTALLATION OF ALL NECESSARY AND USEFUL CAPITAL EQUIPMENT AND OTHER TANGIBLE PERSONAL PROPERTY FOR THE CONSTRUCTION OF THE ARCOSA WIND TOWERS MANUFACTURING FACILITY FOR USE BY ARCOSA WIND TOWERS, INC. OR ITS SUCCESSORS OR ASSIGNS; AUTHORIZING THE EXECUTION AND DELIVERY AN INDENTURE, LEASE, BOND PURCHASE AGREEMENT, THE BOND AND OTHER DOCUMENTS IN CONNECTION WITH THE ISSUANCE OF THE BOND AND THE PROJECT; MAKING CERTAIN DETERMINATIONS AND FINDINGS RELATING TO THE BOND AND THE PROJECT; RATIFYING CERTAIN ACTIONS TAKEN PREVIOUSLY; AND REPEALING ALL ACTIONS INCONSISTENT WITH THIS ORDINANCE.
