NOTICE is hereby given that on April 13, 2021 The Village of Los Lunas, co Gregory D. Martin, P.O. Box 1209, Los Lunas, NM 87031, and Elizabeth Iturralde, 58 Edeal Road, Los Lunas, NM 87031, filed Application No. (RG-17065 Enlgd. into SP-5178)-T with the STATE ENGINEER for Permit to Temporarily Change the Point of Diversion, Purpose of Use and Place of Use from Groundwater to Surface Water within the Middle Rio Grande Water Basin per Water Use Lease Agreement under-NMSA 1978, §72-6-1 to 72-6-7 from the date of permit approval up to 10 years henceforth.

Valencia County is the County affected by the diversion and in which the water has been or will be put to beneficial use. This notice is ordered to be published in Valencia County News-Bulletin.

The applicants propose to temporarily discontinue the diversion of 18.81 acre-feet per annum (afa) of ground water from seven (7) wells under RG-17065 Enlgd.; being well RG-17065 located at a point where X=338,305.4 and Y=3,852,183.4; well RG-17065-S located at a point where X=341,180.2 and Y=3,852,940.1; well RG-17065-S-2 located at a point where X=339,266.6 and Y=3,854,556.6; well RG-17065-S-3 located at a point where X=339,916.5 and Y=3,856,244.8; well RG-17065-S-4 located at a point where X=338,377.2 and Y=3,853,956.8; well RG-17065 POD 6 located at a point where X=338,599 and Y=3,854,659; and well RG-17065 POD 7 located at a point where X=339,261 and Y=3,854,521; all X&Y coordinates are in meters, UTM Zone 13 North, NAD83, for municipal purposes owned by various owners within the Village of Los Lunas municipal water system, Village of Los Lunas, Valencia County, New Mexico.

The applicants further propose to commence the temporary diversion of 18.81 afa of surface water from the Hell Canyon Lateral and/or Valencia Ditch, with a point of diversion on the Rio Grande at the Isleta Diversion Dam (SP-1690-3), on land owned by the Pueblo of Isleta and leased by the MRGCD located at a point where X=346,037 meters and Y=3,863,880 meters, UTM, Zone 13 North, NAD 83, for the irrigation of 6.27 acres of land described as portions of Tracts A-1-A, A1, A2, and A3, further described as Lands of Lesley & Ann Dollahite on MRGCD Map 76, Valencia County, NM.

The move-to lands are owned by Elizabeth Iturralde and generally located approximately 0.5 miles south of the intersection of NM State Highway 6 and Edeal Road, Los Lunas, Valencia County.

This application is filed under the Water-Use Leasing Act, NMSA 1978, Sections 72-6-1 through 72-6-7.

The surface water rights appurtenant to the subject move-to lands were previously severed under permit SD-06458-A into RG-32878 approved by the State Engineer on March 23, 2005, SD-04644-A into RG-32878-S approved by the State Engineer on September 2, 2005 and SD-04644 into RG-91159, approved by the State Engineer on September 2, 2009.

Upon termination or expiration of the desired permit, the subject water right will automatically revert to the move-from place of use pursuant to the applicable provisions in that permit.

Any person, firm or corporation or other entity asserting standing to file objections or protests shall do so in writing (objection must be legible, signed, and include the writer’s complete name, phone number, email address, and mailing address). If the protest does not include the complete name, phone number, email address, and mailing address, it may be deemed invalid and not accepted for filing unless the Protestant provides with the protest an affidavit stating that it does not have one of the above-listed elements/requirements (phone number, mailing address, email address, etc.). The objection to the approval of the application must be based on: (1) Detriment; if detriment, you must specifically identify your water rights; and/or (2) Public Welfare/Conservation of Water; if public welfare or conservation of water within the State of New Mexico, you shall be required to provide evidence showing how you will be substantially and specifically affected. The written protest must be filed, in triplicate, with the Office of the State Engineer, District 1 Office, located at 5550 San Antonio Drive NE, Albuquerque, NM 87109-4127, on or before July 23, 2021. Facsimiles (faxes) will be accepted as a valid protest if the hard copy is hand-delivered or mailed and postmarked within 24-hours of the facsimile. Mailing postmark will be used to validate the 24-hour period. Protests can be faxed to the Office of the State Engineer, (505) 383-4030. If no valid protest or objection is filed, the State Engineer will evaluate the application in accordance with the provisions of Chapter 72 NMSA 1978.
