NOTICE OF TRUSTEE’S SALE

The following legally described trust real estate and associated personal property will be sold at public auction to the highest bidder on the front steps of the Valencia County Courthouse, 1835 Highway 314 SW, Los Lunas, New Mexico, on July 18, 2023, at 10:00 a.m.:

Tract K-1-A-1-A of LOS MORROS BUSINESS PARK, being a replat of Tracts K-1-A-1 and K-1-A-4, Los Morros Business Park, within the San Clemente Grant in Sections 17, 19, and 20, Township 7 North, Range 2 East, New Mexico Principal Meridian, Village of Los Lunas, Valencia County, New Mexico, as the same is shown and designated on the plat thereof filed in the office of the County Clerk of Valencia County, New Mexico on March 3, 2006 in Map Book J, folio 655.

The property to be sold has a street address of 1300 Desert Willow Road, Los Lunas, New Mexico.

Beneficiary/Secured Party: Romspen Investment LP

The sale will be pursuant to the Deed of Trust Act and the power of sale provisions of that Deed of Trust recorded on April 4, 2022 in the real estate records of Valencia County, New Mexico, as Instrument No. 202204650 (“Deed of Trust”).

In addition to the real property described above, the sale will include all Mortgaged Property, as such term is defined in the Deed of Trust (the “Property”).

The Property will be sold “AS IS” in one lot to the highest bidder for cash, free and clear of all liens of the parties hereto and all persons claiming under and through the parties or any persons claiming an interest by an instrument filed for record on or after April 10, 2023. Every bid made shall be deemed an irrevocable offer until the sale has been completed, and the sale is completed when confirmed by the Court. In the event the purchaser fails to pay the purchase price at sale, or make satisfactory arrangements with the Trustee for such payment, the Trustee may accept the next highest bid or proceed with the sale of the Property to the highest bidder. The Trustee may postpone or continue the sale by public declaration at the time and place originally scheduled for such sale. No other notice of the postponed or continued sale need be given.

The purchaser of the Property will take it subject to rights of redemption, any unpaid property taxes, municipal charges, or assessments. The Beneficiary under the Deed of Trust or its assignee has the right to bid at the sale all of the amount owed or any portion thereof for credit pursuant to Section 48-10-14(A) NMSA 1978. TRANSFER OF TITLE SHALL BE WITHOUT WARRANTY OR REPRESENTATION OF ANY KIND. ALL PROSPECTIVE PURCHASERS AT THE SALE ARE ADVISED TO MAKE THEIR OWN EXAMINATION OF THE PROPERTY AND TITLE AND TO CONSULT THEIR OWN ATTORNEY BEFORE BIDDING.

The proceeds of the sale shall first be applied to pay the expenses of the sale, then for any costs incurred for the maintenance and protection of the Property, then to satisfy the debt owed to the Beneficiary.

As of July 18, 2023, the following amounts will be due to the Beneficiary and secured by the Deed of Trust:

Principal: $20,100,000.00
Accrued Interest at Note Rate (11.25%): $1,439,093.89
Accrued Interest at Default Rate (18.00%): $1,078,701.56
Late Fee on Note Interest: $105,945.05
Late Fee on Balance Due to Default: $100,500.00
Amount In Trust: ($12,455.42)
Subtotal: $22,811,785.08

In addition, as of May 31, 2023, $2,282.40 was owed and unpaid for legal fees and costs.

Costs and expenses including, without limitation, reasonable attorneys’ fees, disbursements and other property protection advances, including payments to the Receiver, and any additional costs of collection and suit incurred after May 31, 2023 (to include the cost of publication of this notice, recording fees, and Trustee fees) will be added to the indebtedness and satisfied from the proceeds of the sale.
