NOTICE is hereby given that on May 5, 2023 and amended on May 23, 2023, co-applicants Jordan C. and Beverly K. Pareo and Jimmy C. and Kristy J. Pareo, P.O Box 489, Veguita, NM 87062, and El Paisano Ranch, LLC., c/o Ron Chavez, Manager, P.O Box 513, Tome, NM 87060, and Santa Fe County, c/o Michelle Hunter, Utilities Director, P.O Box 276, Santa Fe, NM 87504-0276, filed with the STATE ENGINEER Application No. SD-02965-AA into SP-05209, for a Permit to Change the Place of Use of Surface Water, within the Middle Rio Grande Water Basin, of the State of New Mexico.

Valencia County and Socorro County are the Counties affected by the diversion and in which the water has been or will be put to beneficial use. This Notice is ordered to be published in the Valencia County News-Bulletin (Valencia County) and in the El Defensor Chieftain (Socorro County).

The co-applicants propose to discontinue the diversion of 95.04 acre-feet per annum (afa) Farm Delivery Requirement (FDR) of surface water, inclusive of a Consumptive Irrigation Requirement (CIR) of 66.50 afa, for the irrigation of 31.68 acres of land, owned by Jordan C. and Beverly K. Pareo and Jimmy C. and Kristy J. Pareo, described as Exempt Land Division Plat Richard Handley Farm, part of Tract A (17.43 acres), located on MRGCD Map Nos. 122, 123 and 124, within projected Sections 7, 12, 13 and 18, within Township 3 North and Ranges 1 East and 2 East NMPM, and part of Tract B (14.25 acres), located on MRGCD Map Nos. 123 and 124, within projected Sections 13 and 18, within Township 3 North and Ranges 1 East and 2 East NMPM, (said Replatted Tracts A and B are part of all the tracts originally declared under File No. SD-02965-Amended), irrigated from the San Juan Acequia, with a point of diversion on the Rio Grande at the Isleta Diversion Dam (SP-1690-3), on land owned by the Pueblo of Isleta, located within the Pueblo of Isleta Grant, within projected NE¼ NE¼ SW¼ of Section 24, Township 8 North, Range 2 East, NMPM, at a point where X=346,037 meters and Y=3,863,880 meters intersect, UTM Zone 13N, NAD 1983. The move-from tracts are generally located north of Las Nutrias Rd., and south of Jaramillo Loop, Veguita, Socorro County, New Mexico.

The co-applicants further propose to transfer the 95.04 afa FDR of surface water, inclusive of a CIR amount of 66.50 afa, for the irrigation of 31.68 acres total, owned by El Paisano Ranch, LLC., described as Tract 18E2A2 (15.988 acres), located within projected Sections 15 and 22, within Township 6 North, Range 2 East NMPM and Tract 18E3B (4.67 acres), Tract 18E3A1 (7.45 acres), and part of Tract 18E3A2A1 (3.572 acres), located within projected Section 22, within Township 6 North, Range 2 East NMPM, all located on MRGCD Map No. 88, from the Hell Canyon Lateral and the La Constancia Acequia, with the same point of diversion on the Rio Grande being the Isleta Diversion Works (SP-1690-3). The move-to tracts are generally located south of Romero Rd., east of the Hell Canyon Lateral and west of the La Constancia Acequia, Tome, Valencia County, NM. The surface water rights were severed from the subject move-to lands, under Permit No. SD03615-B into SP-4842, approved by the State Engineer on April 16, 2010.

Upon action, this application would terminate and permanently replace the temporary lease and transfer of surface water rights under Application No. (SP-4842 into SD-03615-B)-T, filed on May 5, 2023. Santa Fe County is a co-applicant of both applications.

Any person, firm or corporation or other entity asserting standing to file objections or protests shall do so in writing (objection must be legible, signed, and include the writer’s complete name, phone number, email address, and mailing address). If the protest does not include the complete name, phone number, email address, and mailing address, it may be deemed invalid and not accepted for filing unless the Protestant provides with the protest an affidavit stating that it does not have one of the above-listed elements/requirements (phone number, mailing address, email address, etc.). The objection to the approval of the application must be based on: (1) Impairment; if impairment, you must specifically identify your water rights; and/or (2) Public Welfare/Conservation of Water; if public welfare or conservation of water within the State of New Mexico, you shall be required to provide evidence showing how you will be substantially and specifically affected. The written protest must be filed, in triplicate, with the Office of the State Engineer, District 1 Office, located at 5550 San Antonio Drive NE, Albuquerque, NM 87109-4127, on or before August 3, 2023. Facsimiles (faxes) will be accepted as a valid protest if the hard copy is hand-delivered or mailed and postmarked within 24-hours of the facsimile. Mailing postmark will be used to validate the 24-hour period. Protests can be faxed to the Office of the State Engineer, (505) 383-4030. If no valid protest or objection is filed, the State Engineer will evaluate the application in accordance with the provisions of Chapter 72 NMSA 1978.
